Employer Terms of Business

These Terms of Business form the commercial agreement between you (the Employer) and Axiom People, a trading name of Tailormade Recruitment Ltd, a company registered in Ireland. They apply to all employer accounts, whether you access the platform on a pay-as-you-go basis or under a membership plan. By registering as an employer or ticking the introduction acknowledgment on the platform, you accept these terms in full.
1. Definitions
In these terms, the following words have the meanings given:
- Axiom People means the talent marketplace platform operated by Tailormade Recruitment Ltd at axiompeople.com.
- Employer means the organisation or individual registered on the platform to access candidate profiles and make introduction requests.
- Candidate means any individual whose profile is accessible on the Axiom People platform.
- Introduction means the point at which a candidate's identity is revealed to an Employer following the candidate's consent, or any earlier point at which a candidate is made identifiable to an Employer through the platform or by any other means connected to Axiom People.
- Placement means the engagement of a Candidate by an Employer in any capacity — permanent, fixed-term, contract, or consultancy — within 12 months of an Introduction.
- Base Salary means the fixed annual cash remuneration stated in the Candidate's accepted written offer, excluding bonus, commission, overtime, allowances, pension contributions, and any other variable or benefit element.
- Membership means a credit-based subscription plan (Starter, Growth, or Scale) as described on the pricing page.
- Pay As You Go (PAYG) means access to the platform on a rolling monthly basis without a credit subscription.
2. Platform Access
Employer accounts are approved at the sole discretion of Axiom People. Approval is not automatic and may be withheld or revoked where Axiom People reasonably considers the Employer unsuitable to access candidate profiles.
Approved Employers may access candidate profiles, open introduction requests, and use platform features in accordance with these terms and the general Terms of Use.
Candidate profiles are anonymous by design. A Candidate's name, employer, and contact details are only disclosed after the Candidate has individually consented to an introduction with that specific Employer.
3. Pay As You Go Access
Employers who access the platform on a pay-as-you-go basis are charged a platform access fee of €199 per month (excluding VAT where applicable). This fee covers full access to candidate profiles and all platform features for the calendar month in which it is paid.
The monthly access fee is payable whether or not a hire is made or in progress during that month. The fee is for access to the platform, not for any specific outcome.
In addition to the monthly access fee, a placement fee of 12% of the Candidate's first-year Base Salary is payable upon each Placement made within 12 months of an Introduction, as set out in clause 5.
Pay-as-you-go access may be cancelled at any time by written notice to derek@axiompeople.com. Cancellation takes effect at the end of the current monthly billing period. No refund is issued for a partial month. The 12-month introduction period and any outstanding placement fee obligations survive cancellation.
4. Membership Access
Employers who subscribe to a Membership plan (Starter, Growth, or Scale) access the platform under the terms described on the pricing page and any separate membership agreement. Membership terms, credit structures, and the 12-month commitment clause are governed by those documents and are incorporated into these Terms of Business by reference.
Members pay no placement fee per hire; instead, each Placement draws credits from the Employer's account at the rate set by the Candidate's Base Salary band:
- Standard — up to €60,000 Base Salary: 1.00 credit
- Senior — €60,001 to €100,000 Base Salary: 1.75 credits
- Executive — above €100,000 Base Salary: 2.50 credits
The salary band is determined by the Base Salary in the Candidate's accepted written offer and is set by Axiom People based on evidence of that offer. Hires beyond the included annual credit allowance are charged at the applicable à la carte rate.
5. Placement Fees — Pay As You Go
A placement fee of 12% of the Candidate's first-year Base Salary becomes payable when an Employer makes a Placement within 12 months of an Introduction, regardless of whether the Employer's pay-as-you-go account remains active at the time of Placement.
The placement fee is calculated on the Base Salary only. Where a Candidate is engaged on a part-time or fixed-term basis, the fee is calculated on the full-time equivalent annual Base Salary.
Where a Candidate is engaged in a non-salaried capacity (for example, as a day-rate contractor), the fee is calculated on the annualised equivalent of the agreed day rate, based on 220 working days.
Where the offer is denominated in a currency other than Euro, the Base Salary is converted at the European Central Bank reference rate on the date of the Candidate's accepted offer.
The Employer must notify Axiom People in writing within five business days of accepting a Candidate's offer. Invoices are issued on the Candidate's agreed start date and are payable within 14 days of the invoice date.
6. Introduction Period
The introduction period is 12 months from the date of Introduction. If an Employer engages a Candidate in any capacity within this period — including where the Employer cancels its platform access after the Introduction but before engagement — the applicable fee remains payable in full.
The introduction period applies regardless of how the engagement arises, including where the Candidate is engaged through a third party, a holding company, an associated entity, or any other connected person.
7. 90-Day Free Replacement Guarantee
If a placed Candidate leaves or is dismissed within 90 days of their agreed start date, Axiom People will use reasonable endeavours to source a suitable replacement Candidate for the same role at no additional placement fee.
The guarantee applies on the following conditions:
- The Employer has paid all outstanding invoices in full.
- The Employer notifies Axiom People in writing within five business days of the Candidate's departure.
- The role remains open and the original brief is substantially unchanged.
- The departure is not due to redundancy, restructuring, or a material change in the role by the Employer after the Candidate's start date.
The guarantee is a commitment to source and introduce a replacement Candidate. It does not guarantee a successful Placement, and no refund of the original placement fee or access fee is made under any circumstances.
8. Candidate Confidentiality
Candidate profile information — including the reference code, professional details, and any information revealed following an Introduction — is shared with the Employer solely for the purpose of assessing suitability for a specific role. The Employer agrees to:
- Keep all Candidate information strictly confidential and not share it outside the hiring team involved in that specific search.
- Use Candidate information solely for legitimate recruitment purposes and not for any commercial, marketing, or other purpose.
- Not approach a Candidate whose Introduction has been declined or who has not consented to an introduction with that Employer.
- Delete or destroy Candidate information if a Placement is not made, upon request from Axiom People or the Candidate.
Breach of this clause is a material breach of these terms and entitles Axiom People to terminate the Employer's account immediately and to pursue any available remedy.
9. Salary Information on Candidate Profiles
Candidate profiles display a salary range in one of two forms, and the Employer acknowledges the difference between them:
- Salary expectation. Where a Candidate has stated a salary range themselves, the profile shows it labelled as a salary expectation.
- Market rate. Where a Candidate has not stated a salary, the profile displays an indicative market rate for that role, experience level and location, derived from The Going Rate — Axiom People's benchmark drawn from industry salary data and anonymous salary submissions. It is labelled on the profile as a market rate.
A market rate is not a representation, statement or commitment by the Candidate. It does not constitute a salary expectation, demand or offer, and the Employer must not rely on it as the basis of any offer of employment or as evidence of what a Candidate will accept. Any salary discussion is to take place directly with the Candidate following an Introduction. Axiom People gives no warranty as to the accuracy or currency of any market rate, which is indicative only and may be updated as benchmark data changes.
10. Employer Obligations
The Employer agrees to:
- Provide accurate information about roles, requirements, and the organisation at all times.
- Notify Axiom People promptly if a role is filled by any means other than through the platform, where a Candidate introduced through the platform was under active consideration at the time.
- Treat Candidates with dignity and respect throughout any hiring process.
- Comply with all applicable employment, equality, and data protection law in connection with its use of the platform.
11. Fees, Invoicing, and Late Payment
All fees are stated exclusive of VAT. VAT is charged at the applicable Irish rate where required by law.
Invoices are payable within 14 days of the invoice date. Where payment is not received by the due date, Axiom People reserves the right to:
- Suspend the Employer's platform access until all outstanding amounts are settled.
- Charge statutory interest on the overdue amount under the Late Payment of Commercial Debts legislation.
- Pursue recovery of the outstanding amount as a debt, together with reasonable costs of recovery.
12. Limitation of Liability
Axiom People does not guarantee that the platform will result in a successful Placement, that any Candidate will be suitable for any role, or that the platform will be available without interruption. To the fullest extent permitted by law, Axiom People's aggregate liability to the Employer under or in connection with these terms shall not exceed the total fees paid by the Employer in the three months preceding the event giving rise to the claim.
Axiom People is not liable for any indirect, consequential, or economic loss, including loss of profits, loss of business, or wasted management time.
13. Termination
Axiom People may terminate an Employer's account immediately and without notice where the Employer:
- Breaches any material term of these terms and fails to remedy the breach within seven days of written notice.
- Uses Candidate information for any purpose other than legitimate recruitment.
- Engages in conduct that Axiom People reasonably considers harmful to Candidates or to the integrity of the platform.
- Fails to pay any invoice by the due date and does not remedy the failure within seven days of a payment reminder.
Termination does not affect any accrued rights or obligations, including the obligation to pay any placement fee arising from an Introduction made before termination.
14. Changes to These Terms
Axiom People may update these Terms of Business from time to time to reflect changes in the platform, pricing, or applicable law. Any material changes will be notified to active Employer accounts by email at least 30 days before they take effect. Continued use of the platform after that date constitutes acceptance of the revised terms.
15. Governing Law and Disputes
These terms are governed by the laws of Ireland. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Irish courts. Before commencing formal proceedings, both parties agree to attempt to resolve any dispute by good-faith negotiation for a period of not less than 30 days.
